These Terms & Conditions (“Terms”) govern your access to and use of the website https://fabrivio.co.in and any purchase of products from FABRIVIO INNOVATIONS PVT. LTD. (“we”, “us”, “our”). By visiting or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the site or place an order.

1. Definitions

  • “Company” refers to FABRIVIO INNOVATIONS PVT. LTD.
  • “Website” refers to https://fabrivio.co.in and related subdomains.
  • “User/You/Customer” refers to any person accessing the Website, placing an order, or receiving products from us.
  • “Products” refers to the physical goods offered for sale on the Website.
  • “Order” means your request to purchase one or more Products via the Website.

2. Accepting the Terms & Services

  • By using the Website or placing an Order, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.
  • Use of the Website and purchase of Products constitutes acceptance of these Terms, our Return & Refund Policy (as applicable), and any other policies posted on the site.

3. Product Information, Pricing & Availability

  • We strive to ensure that all product descriptions, images, sizes, colours and measurements are accurate. However, actual product appearance (colour, shade) may vary slightly due to screen/display settings.
  • Prices displayed on the Website are in INR and include applicable taxes (VAT/GST or similar). We reserve the right to change prices at any time, but price changes will not affect orders already placed.
  • In case of an obvious pricing error (e.g. due to typographical mistake), we may cancel the Order even after confirmation. If payment was received, we will refund the amount.
  • Availability of products is subject to stock. If an item is out of stock after placing an order, we will inform you and refund or allow you to choose another product.

4. Payment & Order Processing

  • We accept payment via the methods displayed on the Website (cards, net-banking, etc.). We may perform pre-authorisation checks before dispatch. Products will not be shipped until payment is confirmed.
  • For payment gateways or third‑party payment platforms, you are responsible for any issues arising from network problems or failures from payment providers. We bear no liability for such errors.

5. Delivery & Shipping

  • We ship to the address provided by you during checkout. Delivery timelines will be as indicated at checkout; however, delays may occur due to unforeseen circumstances (e.g. courier delays, logistic issues).
  • Once the product is dispatched and handed over to courier/logistics, the risk transfers to you (customer). We are not responsible for loss or damage during transit after dispatch. Net Lawman+1
  • In case of delay, we will notify you via email/SMS. But we cannot guarantee or compensate for customer inconvenience (e.g. mental stress) caused by delayed delivery. (As done in similar e‑commerce T&C.)

6. Return, Refund & Cancellation (Reference)

  • For orders that have not yet shipped, you may cancel or modify your order (change address, size, product, etc.) by contacting us via email at fabrivioinno@gmail.com.
  • Once an order ships, cancellation is not possible. For returns or refunds, our separate Return & Refund Policy applies.
  • You must ensure returns are made according to the Return & Refund Policy requirements (original condition, tags intact, etc.).

7. Intellectual Property Rights

  • All content on the Website — including text, graphics, logos, images, product designs, and software — are owned or licensed by the Company. You may not reproduce, copy, modify, publish or distribute any content without our prior written consent. This protects our rights and avoids misuse. Net Lawman+1

8. User Conduct & Acceptable Use

  • You agree not to misuse the Website (e.g. no hacking, no posting harmful content, no fraudulent activities).
  • You warrant that all information you provide (address, payment info) is accurate and up-to-date.
  • You agree not to use our Website for unlawful transactions or purposes.

9. Limitation of Liability & Indemnity

  • The Company is not liable for indirect, incidental, special or consequential damages (lost profits, data loss, etc.) arising out of your use of the Website or purchase of Products.
  • You agree to indemnify and hold the Company harmless from any claims, liabilities, damages, or expenses arising from your breach of these Terms or misuse of the Website.

10. Changes to Terms & Conditions

  • We reserve the right to modify or update these Terms at any time. Changes will be effective upon posting on the Website. Your continued use of the Website after such changes constitutes acceptance of the new Terms.
  • It is your responsibility to check the Terms regularly.

11. Governing Law & Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of courts in Mumbai / Maharashtra.
